1. Application

These Terms of Use (the “Terms”) set out the common conditions for software products, related documentation, downloads, and support (collectively, the “Products”) sold or provided by Interceptor Inc. (“Interceptor,” “we,” “our,” or “us”).

If a Product is subject to a separate end user license agreement, product page, order terms, or third-party license, those individual terms also apply to that Product or component. If an individual term conflicts with these Terms, the individual term controls.

2. Software License

Our software is licensed, not sold. A purchase provides a license to use the software under the applicable end user license agreement and purchase terms; it does not transfer ownership of the software. Device limits, eligible users, commercial use, simultaneous use, and other license terms may differ by Product and are governed by the applicable individual terms.

3. Purchases, Payment, and Delivery

Prices are displayed on each product page. We currently use Stripe for online purchases, and payment is collected at the time of purchase. Digital products can be downloaded using the method provided after payment is completed.

4. Trials and License Activation

Some Products may include a Trial. The Trial period, available features, limitations after the Trial, and license-activation requirements are stated on the applicable product page and in the applicable end user license agreement. An internet connection may be required for license activation.

INT DCP Baker v1.0 includes a seven-day Trial from first launch. After the Trial ends, license activation is required to create images or use Bake.

5. Restrictions

Except where permitted by law, the applicable end user license agreement, or an applicable third-party license, users may not:

  • copy, redistribute, sell, lend, transfer, or provide a Product to a third party beyond the licensed scope;
  • remove or alter a rights notice, license notice, or NOTICE file;
  • modify, analyze, reverse engineer, or distribute a derivative work without authorization;
  • circumvent license activation, a Trial, a device limit, or another technical restriction; or
  • use a Product in violation of law, to infringe a third party’s rights, or to interfere with operation of the Product or our Services.

6. Updates

We may provide updates to correct issues, improve features, change supported environments, or for other reasons. The scope, period, price, and conditions of an update will be stated on the product page, in the applicable end user license agreement, or in the update notice. If an application checks for update information, that does not necessarily mean it will automatically download or install an update.

7. Support

We accept Product inquiries through the support channel we designate. We will investigate and respond within a reasonable scope, but do not guarantee a response deadline, resolution of a problem, operation in an individual environment, or support for a particular deadline. Product-specific support terms, if any, also apply.

8. System Requirements and User Responsibilities

Supported operating systems, hardware, required third-party software, and other system requirements are stated on the applicable product page or in the accompanying documentation. Before use, the user is responsible for confirming the operating environment, intended operation, storage location, and write target, and for maintaining backups of important data.

9. Returns, Refunds, and Cancellations

Due to the nature of digital products, returns and refunds are generally not available after purchase. This does not apply where a Product has a serious defect or where applicable law requires a return, refund, or other remedy.

10. Intellectual Property and Third-Party Components

Copyright and other rights in the Products and related materials created by Interceptor belong to Interceptor or the applicable rights holder. Third-party components are subject to their respective license terms, copyright notices, and NOTICE materials. If a third-party license conflicts with these Terms, that third-party license controls for the applicable third-party component.

11. Warranties and Liability

Product-specific warranties, disclaimers, and limitations of liability are set out in the applicable end user license agreement. Where a disclaimer or limitation is not permitted by law, or where liability results from our intentional misconduct or gross negligence, applicable law will control.

12. Suspension and Termination

If a user materially breaches applicable terms, misuses a Product, redistributes it without authorization, or engages in comparable conduct, we may terminate the applicable license or take another measure in accordance with the applicable end user license agreement and applicable law.

13. Changes to These Terms

We may revise these Terms in accordance with applicable law in response to changes in law, a Product, or the method of provision. We will provide notice of material changes on our website or by another appropriate method.
